Anyone who lets residential accommodation, such as houses, flats, bedsits, holiday homes or caravans as a business activity is required by Law to ensure the equipment they supply as part of the tenancy is safe.
The Electrical Equipment (Safety) Regulations 1994 requires that all mains electrical equipment (tumble dryers, cookers, washing machines, fridges, kettles etc.) either new or second hand and supplied with the accommodation must be safe to use.
Landlords therefore need to regularly maintain the electrical equipment they provide. The supply of goods occurs at the start of the tenancy so it is essential to have the equipment checked prior to tenants moving in.
A record should be made of the goods supplied as part of the tenancy agreement and of the checks made on those goods. You should obtain and retain test reports detailing the equipment, the tests carried out and the results.
From a tenant's perspective, it is essential that a property is checked prior to moving in to ensure that all appliances supplied are in a safe working condition. Records should be available from landlords detailing the appliances supplied as part of the tenancy agreement and the checks made on those goods.
